Welcome to Daylight. We’re the first and only digital banking platform in the U.S. specifically designed for the LGBTQ+ community by the LGBT+ community. We’re based in Los Angeles, but operate across the United States. As a digital banking platform and provider of various banking services to monitor individuals’ banking, and related financial transactions in order to provide useful guidance, financial advice and management tools (the “Services”), we receive and process personal data of individuals. As we value your privacy, we ave instituted a comprehensive data protection compliance framework in order to fulfil our responsibilities to protect your personal data. Therefore, this general online privacy policy (the “Privacy Policy”) is intended to inform you about our practices regarding the collection and use of your personal data that you may submit to us through our website www.joindaylight.com (the  “Website”).

This type of information includes for example your gender, city or state of residence, age, industry, financial profile and information, demographic profile and other non-identifying characteristics. We may collect, receive and store such information when you directly provide it to us through the Services, when you give us access to such information retained in your computer or accounts or when we collect such information from available public and third-party sources.

• Information from your computer, smartphone, tablet or other mobile devices, such as (i) Unique device identifiers (for example Media Access Control (MAC) and Internet Protocol (IP) addresses), (ii) Browser type, version, language, and display/screen settings, (iii) Information about how you use and interact with our Website (for example page visited, links clicked), (iv) Responses to advertisements on the Website where we advertise, and (v) Social media preference.

• Cookies and similar tracking technologies (please see our Cookies Policy).

• User Content is for example information, data, text, files, graphics, photographs, messages, communication or other materials that you uploaded or submitted to us.

• Protected Class Information. Daylight does not generally collect information relating to your status as a member of a protected class under federal or California law. However, Daylight does collect and disclose your date of birth for the purposes applicable to traditional identifiers, described above. Your date of birth necessarily indicates whether you are a member of the protected class of persons age 40 or older, but Daylight does not use or share the fact that you belong to this group for any purpose.

Daylight makes it easy for you to keep your personal data accurate, complete, and up to date. We will retain your personal data for the period necessary to fulfill our contractual obligations and the purposes outlined in this Privacy Policy. When assessing these retention periods we carefully examine our need to collect personal data at all and if we establish a relevant need we only retain it for the shortest possible period to realize the purpose of collection unless a longer retention period is required by law.

• Affiliates and Subsidiaries of Daylight. In order to provide the best possible Services, we may cooperate with our affiliated companies and subsidiaries. • Third-Party Service Providers, Vendors and other External Service Providers who have contracts with Daylight (the “Third-Party Service Providers”). We may employ other companies, vendors, service providers and individuals (non-affiliated third party) to perform functions or services for us or otherwise act on our behalf. Non-affiliated third party means any entity that is not an affiliate of, or related by common ownership or affiliated by corporate control with us, but does not include a joint employee of that institution and a third party. Please note that we use reasonable efforts to require these companies to (i) provide adequate protections for PII that are no less protective than those set out in this Privacy Policy, and (ii) use PII only for the purposes for which the third party has been engaged by us. 10. Access and opt-out

If your personal data changes, or if you no longer desire our Services, you may correct, update, amend, delete or ask to have it removed from our Website by contacting us at the number below or postal mail at the contact information listed below. We will respond within a reasonable timeframe. When you are no longer our customer, we continue to process your information as described in this Privacy Policy (for example in order to comply with applicable tax, accounting, and legal requirements, or contractual obligations, audits and policies).

If at any time you would like to stop receiving promotional emails from us, you may opt out of receiving these secondary communications. To opt out, you must select the “Unsubscribe” link present in each email we send out to our customers. You can also unsubscribe by updating your account preferences when you access your personal account information. We reserve the right to send customers notification and administrative emails, which are considered a part of our Services.

California

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal data to third parties for their direct marketing purposes. Moreover, you have the right to restrict the sharing of your personal data and financial information with our affiliates (companies we own or control) and outside companies with whom we do business. We are aware of your rights afforded to California residents under the California Consumer Privacy Act or “CCPA.” Even though the CCPA does not apply to us now, we are ready to protect your personal data and give you an option to exercise your right under CCPA once it becomes applicable.
